According to the provisions of the Investment Code 2020, an investment registration certificate (IRC) is a paper or electronic document recording the investor’s registration information about an investment project.

The normal IRC registration dossier for foreign investment in Vietnam mainly includes the following information:

• Investor information
• Information about the company to be established (such as name, form of company, charter capital, percentage of contributed capital)
• Information about the project to be established (such as name, location, objectives, scale, capital source and capital mobilization plan, deadline, implementation schedule);
• Documents on the investor’s legal status;

For businesses and investors, the preparation of an environmental impact assessment (EIA) report before implementing a project in Vietnam is a must.

EIA report making process

After determining the required documents to prepare an EIA report, the enterprise needs to perform the following tasks:

– Conduct survey on geographical, geological, meteorological and hydrological conditions where the project is implemented.

– Investigate, survey and collect data on natural conditions, environment, socio-economic situation.

– Survey, measure, collect samples and analyze soil, water, air samples in and around the project area.

– Identify microclimate factors in the project area and assess the current environmental status here.

– Identify sources of emissions, wastewater, solid waste and noise of the project. Simultaneously, statistics, analysis, income and quick assessment of wastes will be generated during the construction and operation of the project.

– Assess the impact of the above pollution sources on the natural, human and social environment where the project is implemented.

– Develop measures to reduce pollution sources as well as limit the impact of these sources on the environment for the project construction phase.

– Develop environmental management plans during the operation of the project and prevent environmental incidents that may occur.

– Proposing a plan to treat wastewater, exhaust gas and solid waste arising from the project’s activities.

– Consult the People’s Committee and the Vietnam Fatherland Front Committee of the ward, commune and town where the project is implemented

– Set up a council to appraise and approve the EIA report
